Heard learned counsels for the parties.

It is submitted on behalf of the alleged contemnor that in the event the petitioner decides to withdraw the contempt application, the petitioner is at liberty to deposit the punitive charges before the railway authority following which the railway authority shall release the consignment of the petitioner which is the subject matter of the writ petition. It is further submitted that out of 643 packets in the consignment in question, 78 packets have been released in favour of the consignor by the railway authority.

In view of the above, the petitioner seeks to withdraw the contempt application.

The petitioner undertakes to deposit the punitive charges before the railway authority in course of this day. Upon depositing the same by the petitioner, the railway authorities shall release the consignment/remaining part within 36 hours thereafter.

Accordingly, the contempt application being CC No.24 of 2023 is disposed of.

There will be no order as to costs.
