The petitioner submits that the loan amount taken from the bank has been liquidated and the bank is obliged to return the title deed of the petitioner.

It has been brought to the notice of the Court that a civil suit in respect of the same property seeking declaration that the defendant bank was bound to auto renew the various deposits and to repay the said deposit with accumulated interest is pending disposal. In the said suit, prayer has also been made for interest pendente lite and for damages. 3.

As the secured asset is the subject matter of the pending suit, accordingly, it will be open for the petitioner to approach the learned civil Court where the proceeding is pending for further necessary relief in accordance with law.

The writ petition stands disposed of.
