Counsel for the defendant has filed the present application being GA-COM/2/2025 praying for setting aside the ex parte judgment by this Court dated 24th September, 2024.

The matter was taken up for hearing on 21st January, 2025, 24th January, 2025 and 14th February, 2025.

Today when the matter was called, Counsel for the plaintiff has handed over the screenshot of the instruction received through WhatsApp wherein the defendant/judgment debtor informed that due to personal

difficulties, the defendant/judgment debtor is not in a position to proceed with the matter pending before this Court.

On the basis of the said communication, learned Counsel appearing for the defendant/judgment debtor submits that the defendant is not interested to proceed with GA-COM/2/2024 and prays for withdrawal of the same.

In view of the submission made by the Counsel for the defendant/judgment debtor, GA-COM/2/2025 is dismissed as withdrawn. (KRISHNA RAO, J.) Sbghosh
