The Court:- The petitioner applied for compassionate appointment upon the death of his father who was an Ex Gram Panchayet Karmee, Charicha Gram Panchayet under Mohd. Bazar Development Block. It is submitted that the Deputy Director of Panchayet & Rural Development, West Bengal, had requested the Joint Secretary to the Government of West Bengal, Department of Panchayet and Rural Development, by a letter dated June 18, 2019 for a decision with regard to the proposal for appointment of the petitioner.

It appears that the Commissioner, Panchayet & Rural Development, West Bengal, had already granted approval to the candidature of the petitioner for being appointed on compassionate ground. The scheme provides that the ultimate decision would be taken by the concerned department. Thus, the Deputy Director, Panchayet and Rural Development, West Bengal, has forwarded his proposal to the Joint Secretary to the Government of West Bengal, Department of Panchayet and Rural Development for a decision.

It is further submitted that the said decision is pending. Having heard the learned counsels for the respective parties, the writ petition is disposed of with a direction upon the Joint Secretary to the Government of West Bengal, Department of Panchayet and Rural Development, to take a decision within a period of six weeks from date of communication of this order, in accordance with law, and issue necessary directions with regard to the proposal for appointment of the petitioner under die-in-harness category. A reasoned order shall be passed and communicated to the petitioner within the aforementioned period. If the petitioner is found eligible, the appointment shall be granted forthwith upon successful compliance of other formalities by the petitioner.

The writ petition is disposed of.
