The Court :-Mr. Banerjee, learned advocate appears on behalf of petitioner and submits, challenge in this writ petition is regarding unauthorised construction. Persons responsible are private respondents. They have preferred appeal before the Appellate Tribunal. In the appeal his client is private respondent. The appeal is fixed for hearing on 6th January, 2021. Mr. Ghosh, learned advocate appears on behalf of the Corporation and submits, questions in this writ petition have been raised in the appeal, which is statutory remedy provided. As such, there is no necessity to proceed with this writ petition.

Mr. Banerjee submits, there be direction upon the Tribunal to expeditiously deal with the appeal. The Tribunal is requested to deal with the appeal as expeditiously as possible.Petitioner is at liberty to obtain and produce this order before the Tribunal.
