...for the petitioner The Court : The affidavit of service is kept on record. Despite service, none appears on behalf of the respondents. The petitioner is a secured creditor. The petitioner has moved this Court under Article 226 of the Constitution of India challenging the delay on the part of the District Magistrate, Nadia in disposing of the application under Section 14 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002.

The prayer of the petitioner is innocuous. An application was filed on January 19, 2024. No hearing has yet taken place.

The writ petition is disposed of directing the District Magistrate, Nadia, to dispose of the application within a period of one month from the date of communication of this order on the basis of a server copy of this order upon following the procedure established by law and upon being satisfied that the bank had fulfilled all the parameters as required by law in the application under Section 14.
