...for DVC The Court : It is submitted on behalf of the award holder that subsequent to the filing of this execution application there has been a stay of the award dated 12 March, 2018 and the entire decretal dues have been paid. In such circumstances, since the award dated 12 March, 2018 has not attained finality no purpose would be served in keeping this application pending. EC/301/2018 stands dismissed.

Liberty is granted to the award holder to file a fresh execution application if the circumstances so warrant in accordance with law. Liberty is also granted to the award holder to take back a copy of the original award after replacing of the same with a photocopy thereof. As suggested by the parties, let the application under Section 34 of the Arbitration and Conciliation Act, 1996 being AP/391/2018 appear in the Monthly List of October, 2023.
