For plaintiffs The Court: At the time of presentation of the plaint, learned advocate appearing for the plaintiffs submits that his client is not willing to institute the suit by presenting the plaint. The proposed suit is for partition and administration as appears from the plaint.

On the prayer of the plaintiffs, the plaint is directed to be de-registered from the data base of this Court since the same has only been allotted a filing number and have not entered the record of this Court as a suit instituted only on the plaint being presented and admitted. This order will, however, not prevent the plaintiffs from filing a suit on the self-same cause since it is in connection with partition and administration of the same estate unless filing of such suit is not barred in law.
