Subhadip Biswas, learned Advocate is appearing for complainant /Official Liquidator.

2. The Complainant has filed the present complaint case against the accused persons on the allegation that inspite of receipt of notice, the exdirectors of the company have not filed their statement of affairs under Section 454 of the Companies Act 1954. Accordingly, the complainant has filed the present application on the allegation that the ex-directors, that is, the accused persons have committed offence under Section 454 (5) and (5A) of the Companies Act. 1956.

3. This Court finds that the accused persons have not submitted their statements in spite of the opportunity given by the Official Liquidator, hence, prima facie it is found that the accused persons have committed an offence u/s 454 (5) and (5A) of the Companies Act. Cognizance is taken.

4. The department is directed to take appropriate steps for issuance of summons upon the accused persons, returnable by 18th June, 2025. (KRISHNA RAO, J.) gb.
