...for the respondent The Court: Heard counsel appearing on behalf of the parties. In the Section 9 application, orders have already been passed in terms of prayers (a) and (b) of the Notice of Motion on 27th April, 2023. This subsisting interim order shall continue for a further period of eight weeks or until further order passed by the learned Arbitrator, whichever is earlier. The parties have consented to appointment of an Arbitrator and have also agreed upon Mr. Utpal Bose, Senior Advocate, to be appointed as sole Arbitrator to resolve the disputes between the parties.

Accordingly, I appoint Mr. Utpal Bose, Senior Advocate, Bar Library Club, as an Arbitrator to resolve the disputes between the parties. The appointment is subject to submission of declaration by the Arbitrator in terms of Section 12(1) in the form prescribed in the Sixth Schedule of the Act before the Registrar, Original Side of this Court within four weeks from today. Let this order be conveyed to the Arbitrator by the Registrar, Original Side forthwith.

The parties shall be at liberty to file appropriate Section 17 application before the learned Arbitrator. The learned Arbitrator is requested to decide on the same expeditiously as the same involves a going concerned. AP No. 242 of 2023 is, accordingly, disposed of. (SHEKHAR B. SARAF, J.) B.Pal
