1. Ms. Sarbani Ghosal, learned advocate appearing for the plaintiff nos. 1, 2, 3, 4, and 5 and Mr. Banerjee, learned advocate for the defendant nos. 1 to 14, 18 and 19 are present.

2. It is submitted by the learned advocates that the suit is settled by plaintiff nos. 1 to 5 and the defendant nos. 1 to 19 by entering into terms of settlement dated 21st May, 2025. It is submitted by the learned Advocate by producing a copy of the order of National Company Law Tribunal, Kolkata Bench in TP No. 86/2017 that defendant no. 18 namely G.S. Global Projects Private Limited has merged with defendant no. 15 M/S Macro Telecom Private Limited, defendant no. 16 Nirjhar Vyapaar Private Limited and defendant no. 17 G.K. S. Finvest Private Limited.

3. It is further submitted by Mr. Banerjee that by virtue of the merger, GS. Global Projects Private Limited, defendant no. 18 herein is empowered to enter into a terms of settlement in the instant matter.

4. The learned Advocates submit that a decree be passed in accordance with the terms of settlement.

5. Upon perusing the terms of settlement and upon hearing the learned advocates, this Court is of the view that prayer should be allowed.

6. Thus, I allow the prayer made by the parties.

7. Let the suit be disposed and decreed in accordance with the terms of settlement dated 21st May, 2025. As order of substitution is already passed in this matter whereby the defendant nos. 15, 16 and 17 is merged with defendant no. 18, the names of defendant no. 15, 16 and 17 may be deleted from the cause title upon proper verification.

8. Let the decree be drawn up expeditiously in accordance with the terms of settlement.

9. These terms of settlement will be a part of this compromise decree. (BISWAROOP CHOWDHURY, J.) gb.
