...for the respondent The Court: The present application under Section 29-A of the Arbitration and Conciliation Act, 1996 has been necessitated primarily due to the Presiding Arbitrator of the three-member Arbitral Tribunal having expressed his inability to continue in the matter. Upon hearing learned counsel, AP/116/2024 is allowed, thereby appointing Mr. Surajit Nath Mitra, Senior Advocate, as the presiding Arbitrator to continue with the arbitral proceeding between the parties from the stage which it has reached till date, subject to a declaration being communicated by the said learned Presiding Arbitrator as contemplated under Section 12 of the Arbitration and Conciliation Act, 1996.

The mandate of the arbitral tribunal is extended for one year from this date.

Needless to say, the remuneration of the newly appointed Presiding Arbitrator shall be governed by the provisions of the 1996 Act and the Fourth Schedule thereof.
