The Court:- Learned counsel for the award-holder submits that an order of stay was passed in respect of execution of the award in question by the Division Bench taking up the challenge under Section 34 of the Arbitration & Conciliation Act, 1996. As a condition of the said order of stay, the balance awarded amount was deposited with the learned Registrar, which has subsequently been withdrawn by the award-holder upon furnishing necessary bank guarantee.

As such, it is submitted that the execution case has become infructuous for the time being.

Accordingly, EC/31/2024 is dismissed as withdrawn with liberty to file afresh in the event the occasion so arises.
