The Court: This is an application seeking recalling of an order dated 12 August, 2025 and for restoration of the above suit. It is submitted on behalf of the plaintiff that they were unable to appear on the day the matter was dismissed for default on medical grounds. On behalf of the respondents, it is submitted that there has been gross suppression and distortion by the plaintiff.

The plaintiff has deliberately suppressed an agreement dated 3 June, 2023 and various other such agreements whereby the rights of the petitioner have been assigned to third parties.

In view of the submissions made on behalf of the parties, I find cogent reason and good cause as to why the plaintiff was unrepresented on the day the matter was dismissed for default. The order dated 12 August, 2025 stands recalled.

IP-COM/62/2024 is restored to the original file.

Let IP-COM/62/2024 alongwith the connected interlocutory applications being GA-COM/1/2025 appears in the Monthly List of November, 2025.

In the meantime, the plaintiff is directed to file a Supplementary Affidavit dealing with the agreement dated 3 June, 2022 and similar such agreements, if any, which have been executed. Let such Affidavit be filed by the 27 October, 2025. The Department is directed to correct its records to reflect that GACOM/3/2025, GA-COM/4/2025 and GA-COM/6/2025 stand disposed of.
