The Court:- Both the parties agree that this Court does not have jurisdiction for enforcement of the award and pray for transfer of the proceedings to the appropriate civil court for execution of the award having jurisdiction over the immovable property situated at 50B, Sastitola Road, Kolkata- 700011.

It appears that a similar order dated September 18, 2018 was already passed by the learned Chief Judge, City Civil Court at Calcutta in respect of the property, inter alia, holding that the property was situated within the jurisdiction of the Sealdah Civil and Criminal Court, South 24 Parganas. That order was passed in the stage of considering an application for execution of an interim award.

The execution case and the connected application(s) be transferred accordingly.
