The Court : We have heard Mr. N.K. Chowdhury, learned advocate appearing for the appellant/petitioner and Mr. Bhaskar Prasad Banerjee, learned counsel appearing for the respondent. This is an application for condonation of delay. There is a delay of 116 days. We have perused the affidavit filed in support of the condonation delay application and we find that sufficient

cause has been shown for not preferring the appeal within the period of limitation.

Accordingly, the application for condonation of delay (GA/1/2023) stands allowed.

We have heard the learned advocates for both the parties elaborately. We find that an attempt of the review petitioner is to reargue the matter by bringing in fresh facts, which were never placed before the Court on earlier occasions.
