The Court: The petitioner is represented. None appears on behalf of the respondent nor is any accommodation prayed for on their behalf. It is submitted on behalf of the petitioner that despite the order dated 7th December, 2021 the respondents have failed, neglected and refused to comply with the said order. In view of the aforesaid, the petitioner prays that the order dated 7th December, 2021 be confirmed.

I am prima facie satisfied that the respondent is not interested in contesting the proceedings and is deliberately avoiding the Court. In view of the fact that a sum of Rs.56,12.207/- has become due and payable by the respondent to the petitioner, I am of the prima facie view that there is strong prima facie case, the balance of convenience and irreparable injury also in favour of the petitioner.

Accordingly, the order dated 7th December, 2021 is confirmed. AP/393/2021 stands disposed of.
