..for the defendant in CS No. 190 of 2019 The Court: Counsel for the respective parties are present. There are two counter suits between the parties that is CS No. 130 of 2019 (Smt. Snehalata Gupta and Ors. Vs. Sri Gopal Kumar Gupta and Ors.) and CS No. 190 of 2019 (Gopal Kumar Gupta Vs. Snehalata Gupta and Ors.).

Counsel for the plaintiff has filed the application being GA No. 3 of 2023 by enclosing the Terms of Settlement entered between the parties dated 30th June, 2023.

Counsel for the respective parties submit that in terms of the Terms of Settlement entered between the parties, both the suits have been settled and decree may be passed with respect of both the suits by making Terms of Settlement dated 30th June, 2023 as part of the decree. Considered the submission made by the Counsel for the respective parties and perused Terms of Settlement enclosed in GA No. 3 of 2023 along with two deeds of dissolution of partnership dated 30th June, 2023, deed of settlement of partition dated 30th June, 2023 enclosed and the deeds of gift enclosed with the said Terms of Settlement.

This Court finds that there is no impediment to accept the Terms of Settlement entered into between the parties. Accordingly, the same is accepted and decree is passed in terms of the Terms of Settlement entered between the parties dated 30th June, 2023.

Terms of Settlement entered between the parties dated 30th June, 2023 be made part of the decree.

CS No. 130 of 2019 and CS No. 190 of 2019 are disposed of in terms of Terms of Settlement dated 30th June, 2023. Accordingly, the connected applications also disposed of. Decree be drawn accordingly by making the terms of settlement as part of decree (KRISHNA RAO, J.) Sbghosh
