The Court: Counsel for the petitioner is present and submits that the executor died leaving behind three legal heirs out of which two legal heirs have filed their consent but one of the legal heirs has neither filed caveat nor has given consent. Counsel for the petitioner prays for a direction for issuance of special citation upon one of the legal heirs, namely, Utpal Acharya. In view of the submission made by the Counsel for the petitioner, prayer (b) of the application is allowed.
