The Court:- The respondent, Food Corporation of India has filed three applications in connection with writ petitions number WPO/969/2022, WPO/1828/2022 and WPA/7727/2022 (Appellate Side). By dint of the said applications, the respondent/Food Corporation of India has brought on record the minutes of the meeting between the parties held on November 12, 2025 at 3:00 P.M. thereby coming to settlement as regards the transfer and posting of DPS Labourers as a part of labour rationalisation in the

organisation, which is broadly the subject matter of the instant writ petitions.

Mr. Majumder, learned Senior Advocate appears for the petitioner in WPO/969/2022 and WPO/1828/2022 (Original Side) and Mr. Victor Chatterjee learned Advocate appears for the petitioner in WPA/7727/2022 (Appellate Side).

Applicant/respondent is represented by Mr.

Chattopadhyay, learned Advocate.

It appears that the parties have arrived at a settlement, in all the three writ petitions, as mentioned above. Concerning the issue of transfer and posting of the members of the respective writ petitioners/Unions. Hence, nothing remains to be adjudicated in these writ petitions any further. Considering the facts and circumstances the said writ petitions are taken up for disposal as per the 'Terms of the Settlement' as arrived at in the meeting dated November 12, 2025, which may be quoted below:- "1. It was highlighted from the Management side that there is an urgent requirement to undertake rationalization of DPS Labours within West Bengal region. At present, DPS Labours are engaged in four depots namely, CSD Dabgram, FSD Raigunj, FSD Mangalbari and FSD Durgapur.

There was a detailed deliberation on the matter and subsequent to that it was agreed by both the Management and the Union that labourers posted at CSD Dabgram, Siliguri may be posted to FSD Mangalbari and FSD Durgapur. In this regard, the Union has submitted a list of 81 labourers (Sardar, Mandal, and H/L along with A/W) presently posted at CSD Dabgram, Siliguri for further posting at FSD Mangalbari as a part of Labour Rationalisation. It was also agreed upon by both Management and Union that all DPS Labourers working at FSD Raigunj would be transferred an d posted at FSD Mangalbari as a part of Labour Rationalisation.

2. In continuation to point no. 1 it is agreed by the Union that all court cases relating to CSD Dabgram, FSD Raigunj and FSD Mangalbari would be withdrawn at concerned Court of Law. Subsequently, Management also

agreed that NIT for positioning of Handling Contract Labour at FSD Mangalbari and FSD JJP would be withdrawn. It is agreed that the matter would be reviewed in future in this regard to floating of NIT for Handling Labour Contractor in FSD JJP and FSD Mangalbari in consultation with the Union for further decision.

3. The Representatives of the Union has raised the issue of pendency of promotion of the DLS Labourers transferred from FSD Kalyani to FSD Abdarpur for a long time and the Management has assured the matter will be taken up with the Divisional Manager for immediate necessary action as per prevailing norms and submit a report on it within 15 days.

4. The Representatives of the Union raised the matter regarding nonpayment of arrears of EL Encashment consequent upon of Wage Revision. The Management has assured that matter will be taken up with the concerned Divisional Managers to sort out the issue and submit an ATR within 15 days."

The writ petitions as above are, therefore, disposed of as per the 'Terms of Settlement' as arrived at between the parties and recorded above. However, it is mentioned that the petitioners' right to agitate or challenge any cause of action arising in future, shall remain reserved. In view of the 'Terms of Settlement', the issues in the writ petitions remain undecided as the Court has not entered into the merits of the dispute between the parties.
