...for UOI The Court: Learned counsel for the petitioner submits that the matter was erroneously captioned as one under Section 29-A of the Arbitration and Conciliation Act, 1996 whereas it is substantially under Section 14 read with Section 11 of the said Act. Learned counsel seeks to carry out the necessary amendments to the cause title of the application. However, during the course of arguments, it transpires that the matter pertains to the Commercial Division of this Court but has been filed in the Ordinary Original Civil Jurisdiction.

Accordingly, the petitioner is granted leave to take back the application and re-file it under the appropriate provision of law before the Commercial Division of this Court.
