It is submitted by Mr. Sudhir Mehta, learned Advocate appearing for the appellant that during the pendency of the appeal, subsequent development between the appellant and M/s. Balmer Lawrie & Co. Ltd. being the Container Freight Station has taken place who is sought to be impleaded in this appeal, pursuant to which, the required amount has been

remitted and nothing further requires to be adjudicated in this appeal.

In the light of the said development, the appeal stands disposed of accordingly.

The appellant is at liberty to pursue his claims, if any, in the writ petition and the respondent/department is granted three weeks time to file affidavit-in-opposition after serving copy on the learned Advocate appearing for the writ petitioner and reply, if any, be filed within two weeks thereafter.
