1. Learned counsel for the petitioner, after arguing for quite some time, seeks to withdraw this public interest litigation with liberty to file afresh along with some material to show that the alleged construction made by the respondent No.8 is illegal and unauthorized.

2. The other side has no objection.

3. The PIL is dismissed as withdrawn with the liberty, prayed for.

4. It is made clear that this Court has not expressed any opinion on the merits of the case and on maintainability of the public interest litigation.
