Clause 81 of the limited partnership agreement provides for appointment of an Arbitrator. The parties have left the decision of the Arbitrator upon this Court and have agreed to go for arbitration.

In light of the above submissions made by the Counsel, Ms. Manju Bhuteria, Mob. No.9830128869 is appointed as Arbitrator. The appointment is subject to submission of declaration by the Arbitrator in terms of Section 12(1) in the form prescribed in the Sixth Schedule of the Act before the Registrar, Original Side of this Court within four weeks from today.

Let this order be conveyed to the Arbitrator by the Registrar, Original Side forthwith.

AP/173/2022 is accordingly disposed of.

Allegations made in the petition are deemed to be denied as no affidavits have been used by the parties. Further, I clarify that all points are kept open before the learned Arbitrator.
