The Court: Mr. Swatarup Banerjeee counsel appearing on behalf of the petitioner submits that in spite of several attempts having been made by the Receiver, physical possession of the property has not been taken. He accordingly, prays that this Section 9 application be disposed of with liberty granted to the petitioner to move for arbitration and file appropriate Section 17 application therein. The report of the Receiver be taken on record and the Receiver is discharged accordingly.
