Counsel for the plaintiff submits that there are technical defects in the plaint filed by the plaintiff and accordingly he wants to withdraw the said suit with the liberty to file afresh on the self-same cause of action. In view of the submissions made by the Counsel for the plaintiff, leave is granted to the plaintiff to withdraw the suit. Counsel for the plaintiff has also prayed for leave to allow the plaintiff to use the court fee deposited by the plaintiff in the subsequent suit. Counsel for the plaintiff is given liberty to utilize the court fee in the subsequent suit if any filed in connection with the same matter.
