For petitioner The Court: It is submitted that the executor named in the Will has died. The son of the executor is no more interested to proceed with the matter and seeks withdrawal of the same. Although, the son of the executor claims to be a beneficiary under the will but there may be other legatees to continue with the application by converting the same into an application for Letters of Administration with the Will annexed. No one has come forward though the matter had been adjourned previously.

In the aforesaid facts and circumstances, the probate proceedings being PLA/256/2025 is dismissed for non-prosecution. The original Will on being applied by the son of the executor, shall be returned after observing the requisite formalities. The executor's son shall on the return of the original will

shall keep the same in his custody for being produced as and when required. (ARINDAM MUKHERJEE, J.) Sb/
