...for the respondent The Court: Affidavit of service filed today be kept on record. In view of the recusal of the second Arbitrator who was appointed, which happened after recusal on a previous instance, the present application has been filed for appointment of an Arbitrator.

Accordingly, Mr. Rudranarayan Chowdhury, Advocate and a member of the Bar Library Club, is appointed as the sole arbitrator to resolve the disputes between the parties, subject to a declaration being obtained from him under Section 12 of the Arbitration and Conciliation Act, 1996. The learned Arbitrator

shall fix his remuneration in consultation with the parties and within the framework of the 1996 Act and its Fourth Schedule. The learned Arbitrator so appointed shall take up the arbitral proceeding from the stage which it has reached till now. The erstwhile learned Arbitrator is requested to hand over all relevant documents and papers to the newly appointed Arbitrator, preferably within a fortnight from the date of communication of this order to him.
