The Court: The writ petitioner seeks the removal of a stall located in front of premises No. 111, Netaji Subhas Road, Room No. 39, Ward No. 42, Borough V, Kolkata 700 001. The petitioner claims to have submitted a representation to the Kolkata Municipal Corporation on 4th March 2024, which was received by the Corporation on 7th March 2024, requesting the removal of the said stall. However, the petitioner alleges that no action has been taken by the Corporation in response to this representation.

There is no reason to keep this writ petition pending. Accordingly, I dispose of the writ petition by granting the petitioner the liberty to submit a fresh representation to the Town Vending Committee of the Kolkata Municipal Corporation within two weeks from the date of this order, seeking the removal of the alleged encroachment.

Should such a representation be made, the Town Vending Committee shall consider it within one month from the date of submission and take appropriate steps to remove the alleged encroachment. Accordingly, WPO/661/2024 is disposed of.
