The Court :- In paragraph 1 of the application for grant of probate apart from the address where the testator breathed his last, the permanent address of the testator had been stated to be at 84/1, Roy Bahadur Road, Kolkata 700034 within Kolkata Municipal Corporation but outside the Ordinary Original Civil Jurisdiction of this Court. This address, however, is not mentioned in the cause title. Subject to the petitioner incorporating the said address in the cause title of the application for grant pursuant to leave granted by this order, the probate is granted since all the legal heirs in intestacy have consented to the grant, the Will has been proved in common form by the affidavit of the attesting witness and considering the view of the department upon complete scrutiny. The application for grant of probate is, therefore, allowed by granting order in terms of prayer (a) of the petition. The petition for grant of probate stands disposed of, accordingly.
