The Court: Heard Mr. Ratnanko Banerji, Senior Advocate appearing on behalf of the petitioner.

Mr. Banerji has submitted that all the trustees of the Trust have assessed the present situation, especially considering the huge infrastructural and operational changes necessary and the resultant changes in internal controls required and have come to a unanimous conclusion that it would be in congruity with the Settlor's intentions and in the best interest of the Trust that the amendments are allowed to be carried out. The Board of Trustees have already passed a resolution accepting and approving the proposed amendment and modification to the Original Trust Deed.

Upon consideration, I am of the view that the prayers in the petition should be allowed in terms of prayers (a) and (b). ATA/7/2021 is accordingly disposed of.
