The Court: In view of the urgency pleaded on behalf of the parties, the matter is taken up for hearing.

It is submitted on behalf of both the parties that pursuant to an order dated 23 November 2024 passed in an application under section 11 of the Arbitration and Conciliation Act 1986 a Sole Arbitrator had been appointed and also entered upon reference. However, by a letter dated 23 November, 2024 the Sole Arbitrator has expressed an intention to not to act as Arbitrator for personal reasons. In view of the above, the mandate of the Sole Arbitrator stands terminated. By consent of the parties the Hon'ble Mr. Justice Sanjib Banerjee (Former Chief Justice of Meghalaya and Madras) is appointed as substitute Sole Arbitrator to proceed with the reference subject to the Arbitrator communicating his consent in the prescribed format to the Registrar, Original Side of this Court within three weeks from date of communication of this order.
