...for the plaintiff The Court:- Mr. Prithwish Roy Chowdhruy, learned counsel appears for the plaintiff. Though the matter is fixed today for presentation of plaint but the learned counsel for the plaintiff submitted after going through the record, plaintiff found that the suit is required to be filed before the NonCommercial Division and accordingly praying for withdrawal of the suit to file afresh on the same cause of action before the appropriate Court. In view of the submission made by the counsel for the plaintiff, the plaintiff is granted leave to withdraw the suit with liberty to file before the appropriate Court. The Court fee deposited by the plaintiff may also be refunded to the plaintiff with a liberty to utilize the said Court fee, if the plaintiff files the suit against the same defendant on the same cause of action.

Accordingly, CS-COM/729/2024 is dismissed as withdrawn. (KRISHNA RAO, J.) T.O.
