1. Learned advocate for the petitioners submits that the issue in question has already been decided by a Co-ordinate Bench of this Court on 1st May, 2025 in WPO No.786 of 2023 [Gobinda Dey & Anr. vs. State of West Bengal & Anr.].

2. Prayer has been made to pass similar order as has been passed in Gobinda Dey [supra].

3. Learned advocate representing the respondents submits that an appeal being APO No.39 of 2025 has been carried from the said order but the appeal is yet to be considered.

4. Be that as it may, as it appears that the issue in question has been decided by a Co-ordinate Bench and as the said order is yet to be modified/set aside or vacated by the Hon'ble Division Bench,

accordingly, the Court is minded to pass similar order in the instant case.

5. In view of the above, the order passed in the matter of Gobinda Dey [supra] will apply in the present writ petition, subject, however, to any order that is being passed by the Hon'ble Appeal Court in APO No.39 of 2025.

6. The writ petition stands disposed of.
