The Court:-The petitioner filed the instant writ petition praying for implementing the order of demolition passed by the Special Officer(Building) affirmed by the order passed by the learned Municipal Building Tribunal. The petitioner has presently given written instruction to his learned Advocate-on-record expressing his desire not to proceed with the writ petition any further. Written instruction is taken on record. In view of the submission made on behalf of the petitioner, the writ petition stands dismissed as 'not pressed'.

Dismissal of the writ petition will, however, not stand in the way of the Kolkata Municipal Corporation to take steps for demolition of the illegal and unauthorized construction of the multi storied building standing at premises no. 4A/H/1/1, Ismail Ostagar Lane, P.S.-Ekbalpore, Ward No.79, Borough No.XIV, Kolkata-700023.
