The Court: Counsel for the respective parties are present. Counsel for the plaintiff submits that due to some misunderstanding between the parties on 23rd August, 2023, the Counsel for the plaintiff mentioned before this Court that the plaintiff is not in a position to withdraw the suit and the plaintiff intends to continue the suit. Now, Counsel for the plaintiff submits that the erstwhile advocate appearing for the plaintiff has inadvertently made the submission but the plaintiff does not intend to proceed with the matter.

The plaintiff is also present in Court and on instruction, the Counsel for the plaintiff submits that the order dated 23rd August, 2023 may be recalled and the plaintiff may be allowed to withdraw the suit.

Counsel for the defendant submits that he has no objection if the order dated 23rd August, 2023 is recalled and for withdrawing of the suit by the plaintiff.

In view of the submission made by the Counsel for the respective parties, the order dated 23rd August, 2023 is recalled. In view of the submission made by the Counsel for the plaintiff, CS No. 221 of 2019 is dismissed as withdrawn.
