For the petitioner THIS COURT: The affidavit affirmed by the executrix on 16th May, 2023 filed in Court today is taken on record.

It appears from the said affidavit that the deponent/executrix has undertaken to secure a sum of Rs. 3,50,000/- in favour of the minor grand daughter of the testator being half of Rs. 7,00,000/- being the money available in the estate bequeathed under the subject Will. The executrix has also given a declaration and undertaking that she will also secure 50% of the sale proceeds of the flat being No.103 in Block A/6, Sugam Park, 195 N.S. Road, Narendrapur Kolkata - 700 103 if the same is sold by the executrix subsequent to the grant being given in her favour. Recording such undertaking, the probate to the last Will and Testament left behind by the deceased on 3rd July, 2020 is granted in favour of the petitioner in terms of prayer (a) of the application The application for grant of probate being PLA 336 of 2021 is, accordingly, disposed of.
