1. The petitioner being aggrieved with an illegal construction in the basement and ground floor of the premises no.113, Park Street, Poddar Point, Kolkata - 700 016, a complaint in this regard has been made with the municipal authorities.

2. Having heard the learned Advocates for the respective parties and considering the materials on record, I am of the view that the municipal authorities should hear out and dispose of the aforesaid representation/complaint of the petitioner upon giving an opportunity of hearing to all concerned including the owners and occupiers of the basement and the ground floor of the premises no.113, Park Street, Poddar Point, Kolkata - 700 016.

3. Such decision must be taken in accordance with law upon taking into consideration all factors and submissions made by the respective interested persons. It is expected that decision in this regard shall be taken by the municipal authorities within a period of sixteen weeks from the date of communication of this order.
