Learned counsel appearing for the petitioner submits that the present arbitration petition is premature since the petitioner did not give the respondent the opportunity to reply to the Section 21 notice within 30 days as required under Section 11(5) of the Act.

AP/303/2023 is accordingly dismissed as withdrawn with liberty to file afresh.
