3. In view thereof, the appeal is allowed and disposed of on the basis of the terms of settlement.

4. The original terms of settlement is taken on record.

5. The Department shall draw a decree on the basis of the terms of settlement as expeditiously as possible.

6. The decree passed by the trial Court is, accordingly, set aside.
