1. This is an application for appointment of a learned Arbitrator for settlement of dispute between the parties. The disputes arose out of an agreement for Leave and Licence dated March 31, 2022. The arbitration clause is under Clause 23 of the said agreement. It provides that, in case of any dispute or difference between the parties arising out of the agreement and/or interpretation of terms of the agreement, the dispute shall be referred to adjudication by the sole arbitrator, under the provisions of the Arbitration and Conciliation Act, 1996.

Both the parties submit that there are existing disputes which are required to be adjudicated upon as per the mechanism agreed to.

2. Under such circumstances, the application is allowed by appointing Mr. Rudrajit Sarkar, Advocate (Mob. No.9836121325) as the learned Arbitrator, to adjudicate upon the dispute between the parties. This appointment is subject to compliance of Section 12 of the Arbitration and Conciliation Act, 1996. The learned Arbitrator shall fix his own remuneration as per the Schedule of the Act.
