The impugned order dated 4th October, 2021 is modified to the effect that upon payment of costs assessed at Rs.50,000/- to be paid by the defendant to the plaintiff's advocate-on-record by 26th November, 2021, and a receipt to that effect produced before the department, the defendant will be permitted to file his written statement by 30th November, 2021.

The cost awarded is to compensate the plaintiff on the hearings that had to be attended by their lawyers for extension of time to file the written statement, for further and better particulars and so on. Nothing remains of the appeal. The appeal (APOT No.163 of 2021) and the connected application (GA No.1 of 2021) are disposed of accordingly.
