Mr. Rachit Lakhmani, Mr. Arnab Sardar, Advocates for defendant nos.2 to 5. The Court : The parties had expressed their intention to settle the disputes out of Court which has been recorded in the order dated 13th September, 2022. The defendant no.1 in order to settle the disputes as recorded in the order dated 13th September, 2022 has brought a demand draft of Rs.75,00,000/- (Rupees seventy five lakhs only) bearing no.733990 dated 13th September, 2022 drawn on Kotak Mahindra Bank, Kolkata, Chittaranjan Avenue Branch in favour of the plaintiff. The said demand draft is made over to the learned Advocate for the plaintiff. The plaintiff's claim in the suit as against all the defendants stands settled

full and finally with the receipt of the said demand draft for Rs.75,00,000/-.

As part of the settlement, the defendant no.1 shall take steps for withdrawal of the pending suit filed by the said defendant before the City Civil Court at Calcutta against the plaintiff. Nothing further remains to be adjudicated in the suit. The suit stands disposed of recording full and final satisfaction of the plaintiff's claim as against all the defendants upon having received Rs.75,00,000/-. All applications filed in the suit also stand disposed of and receiver, if any appointed is also discharged. Let a decree be drawn up in terms of the settlement between the parties.
