The Court :- This is an application for grant of probate of the last Will and Testament dated 11th May, 1991 left behind by the abovenamed deceased. The Department has tallied the original Will a portion of which has been torn out with the certified copy of the Will submitted by the propounder. The Department is of the view that the certified copy now placed by the propounder is that of the original Will annexed to the application and as such probate, if granted, can be issued by annexing the photocopy of the original Will as also a photocopy of the certified copy of the Will. The legal heirs in intestacy of the testator being his widow and only daughter have consented to the grant. The Will has been proved in common form through an affidavit of an attesting witness.

Considering the view of the department upon complete scrutiny, the application for grant of probate is allowed by granting order in terms of prayer (a) of the petition.

The petition for grant of probate stands disposed of, accordingly. (ARINDAM MUKHERJEE, J.) snn
