Considered the submission of Ms. Swapna Das, learned Advocate appearing for the petitioner that petitioner wants to withdraw this writ petition and to file appeal against the impugned assessment order before CIT (Appeals) and she further submits that in the meantime, time to file appeal has expired and prays for extension of time to file the appeal. Considering such prayer, this writ petition being WPO No. 2104 of 2022 is dismissed as withdrawn with liberty to file the appeal against the impugned assessment order before the CIT (Appeals) within two weeks from

the date of the communication of this order and if such appeal is filed within the date stipulated herein, CIT (Appeals) will not raise the issue of limitation. (MD. NIZAMUDDIN, J.) Sbghosh
