The Court: Learned counsel for the respondent submits that he has instruction to appear on behalf of the respondent and Vakalatnama will be filed shortly.

With consent, the matter is heard finally.

During the course of hearing, learned counsel for the petitioner submits that there exists an arbitration clause and a live dispute which needs to be taken care of by appointment of an arbitrator. Learned counsel for the respondent does not dispute the existence of an arbitration clause and a dispute and, therefore, Arbitrator can be appointed. In view of the consensus arrived at and considering the nature of dispute, this Court deems it proper to appoint Hon'ble Justice Ranjit Kumar Bag, former Judge, High Court at Calcutta, Flat No.4/2, Anandalok Cooperative Housing Society, BB-50, Action Area-1B, New Town, Kolkata700156 [Phone No.8335073594] as sole Arbitrator. Arbitrator will decide the dispute between the parties in accordance with law. The Arbitrator shall be entitled to fix his remuneration as per Fourth Schedule of the Arbitration and Conciliation Act, 1996. This order is subject to compliance of Section 12 of the Arbitration and Conciliation Act, 1996.

The application is disposed of accordingly.
