...for KMC The Court: The matter is taken up for consideration pursuant to the order dated 29th March, 2023 in presence of the learned advocates representing the petitioner and the Kolkata Municipal Corporation. Mr. Arnab Dutt, learned advocate representing the petitioner submits that the sole petitioner, namely, Baladev Basu @ Dev Basu, has died in the month of December, 2022 and in spite of adjourning the matter thereby granting opportunity to the heirs of the petitioner to take necessary steps, it has been submitted today before this Court on behalf of the petitioner that due to want of instructions, no steps could be taken. Since the time has lapsed for filing substitution application, the writ petition stands dismissed.
