...for Respondent Corporation The Court: Mr. Basu appears on behalf of the writ petitioner. On instruction, he has submitted to the Court that the writ petitioner is no further desirous to proceed in the instant writ petition. Ms. Deblina Chattaraj is appearing for the respondent Corporation. She is, however, seriously objecting to such practice undertaken by the writ petitioner on the ground that the respondent Corporation has been able to submit before the Court, adequate and sufficient documents, regarding provident-fund loan taken by the writ petitioner and in that way the writ petitioner is found to have committed fraud upon the Court by filing the present writ petition.

Be that as it may, the Court finds that the respondent Corporation is not restrained by anyway to proceed in accordance with law against the writ

petitioner in case of any fraud having been committed. So far as the present case is concerned, the writ petitioner is not willing to proceed any further. Writ petition WPO 563 of 2019 is dismissed as not pressed, without any liberty to the petitioner, to file it afresh. (RAI CHATTOPADHYAY, J.) TR/
