...for the Respondent The Court : By this application, the Award Holder seeks permission to readvertise the sale of an immovable property. Learned advocate appearing for the Judgement Debtor submits that, the property concerned is an immovable property lying outside the territorial jurisdiction of this Hon'ble Court.

Learned Advocate appearing for the Award Holder seeks leave to withdraw the execution petition with liberty to apply afresh on the self same cause of action and liberty to obtain the certified copy of the award upon him submitting a photocopy of such award in the records.

In such circumstances, EC No. 473 of 2019 is allowed to be withdrawn by the award holder as prayed for. The award holder is at liberty to obtain the

certified copy of the award holder furnished a duly authenticated copy of the award be kept with the record of the execution petition. In view of the withdrawal of the execution proceedings, I.A. GA No.2 of 2021 does not survive and is also disposed of accordingly. (DEBANGSU BASAK, J.) S.De
