Mr. Aurin Chakraborty, Adv. for the plaintiffs. The Court :- At the time of presentation of the plaint it is submitted by the plaintiffs that on a detail consideration of the averments made in the plaint it will be evident that the suit relates to deliver up and cancellation of a registered document in respect of an immovable property admittedly situate outside the jurisdiction of this Court. It is, therefore, a suit for land and is required to be filed before the appropriate Court wherein the immovable property is situated.

On the prayer of the plaintiffs, the plaint is directed to be returned along with the court fees to the plaintiffs after completing the requisite formalities for being presented before the appropriate Court. The department is directed to de-register the suit number upon the plaint being returned to the plaintiffs.
